Oilfield operations across the Permian Basin put enormous wear on tires. From heavy-haul trucks and drilling rigs to frac equipment and service vehicles, the volume of scrap tires generated at oilfield sites can be substantial. What many operators do not realize is that Texas law — enforced by the Texas Commission on Environmental Quality (TCEQ) — requires businesses that generate scrap tires above certain thresholds to register as scrap tire generators and follow specific storage and disposal rules. Why This Matters for West Texas

Under 30 TAC Chapter 328, any business or individual that generates scrap tires is considered a scrap tire generator. Generators must:

  • Store scrap tires properly — tires must be kept in a manner that prevents mosquito breeding, fire hazards, and unauthorized access. Outdoor storage must be managed to avoid water accumulation inside tires.
  • Use a registered scrap tire transporter — you cannot legally haul your own scrap tires to a disposal site unless you are also registered as a transporter. Tires must be transported by a TCEQ-registered carrier.
  • Dispose of tires at a permitted facility — scrap tires must go to a TCEQ-authorized recycler or processor, not a standard landfill. Most municipal solid waste landfills are prohibited from accepting whole scrap tires.
  • Maintain records — generators are required to keep records of tire quantities, transporter information, and disposal destinations. TCEQ Form 10304 (Scrap Tire Manifest) must accompany each shipment.

Large quantity generators — those accumulating 500 or more scrap tires at any one time — face additional requirements and heightened inspection risk. Oilfield sites with multiple vehicles and equipment can reach this threshold quickly.

Non-compliance carries real consequences. TCEQ can issue notices of violation, assess administrative penalties, and require costly cleanup of illegally stored tire piles. In West Texas, where tire piles can accumulate unnoticed on remote ranch or oilfield property, enforcement actions have resulted in penalties ranging from thousands to tens of thousands of dollars.
